TEAM ARETÉ TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of the services and products provided by Team Areté Ltd ("Team Areté", "we", "us", or "our"), including online and face-to-face coaching services and the sale of fitness apparel.

By engaging with our services or purchasing products, you agree to be bound by these Terms.

1. Coaching Services

1.1 Service Description

Team Areté provides:

  • Online coaching (including workout plans, nutrition guidance, and check-ins)

  • Face-to-face coaching (personal training sessions, group classes)

  • Hybrid coaching models (combining online and in-person support)

1.2 Eligibility

You must be 18 years or older or have written consent from a parent/guardian to participate in our coaching programs.

1.3 Health Disclaimer

You must consult a doctor before beginning any fitness program. Team Areté is not responsible for any injuries or health issues that may arise as a result of participating in our programs.

1.4 Results Disclaimer

Results may vary. We do not guarantee specific outcomes.

1.5 Client Responsibilities

  • Provide accurate personal and medical information

  • Follow safety instructions and training guidance

  • Attend scheduled sessions or give appropriate notice for cancellations (see Section 4)

2. Apparel Sales

2.1 Product Information

We aim to display products accurately. However, colors, sizing, and availability may vary.

2.2 Orders and Payments

All orders are subject to acceptance and availability. Full payment is required at the time of purchase.

2.3 Shipping & Delivery

We aim to dispatch products within 3 business days. Delivery times may vary by location. Team Areté is not liable for delays caused by external couriers.

2.4 Returns and Exchanges

  • Apparel must be returned within 14 days, unworn and in original packaging

  • Sale items may be non-refundable

  • Customers are responsible for return shipping unless the item is faulty

3. Fees and Payment

  • All prices are in $AUD and inclusive/exclusive of applicable taxes

  • Payment for coaching services is due upfront or according to a monthly plan, as agreed upon

  • Failure to pay may result in suspension of services

4. Cancellations and Refunds

4.1 Coaching Services

  • Online Programs: Non-refundable once access has been granted

  • Face-to-Face Sessions: Must be canceled with at least 24 hours’ notice. Late cancellations or no-shows may be charged in full

  • Subscriptions: You may cancel with 14 days’ written notice prior to your next billing cycle

4.2 Apparel

See Section 2.4 above.

5. Intellectual Property

All materials provided by Team Areté (including workout plans, video content, written guides, branding, and logos) are the property of Team Areté and may not be reproduced, distributed, or used for commercial purposes without prior written consent.

6. Privacy

We collect and process your personal data in accordance with our Privacy Policy, which is available on our website. By using our services, you consent to such processing.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Team Areté shall not be liable for any indirect, incidental, or consequential damages

  • Our total liability shall not exceed the amount paid for the relevant service or product

8. Termination

We reserve the right to terminate services without refund if:

  • You breach these Terms

  • You engage in abusive, threatening, or inappropriate behavior

9. Changes to Terms

Team Areté reserves the right to update or modify these Terms at any time. Changes will be posted on our website and become effective immediately.

10. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of [Jurisdiction].
